Terms of Sale
Placing an Order
All orders are subject to acceptance and availability.
Please note that items in your shopping cart are not reserved and may be purchased by other customers. After you place your order, you will be sent an e-mail to confirm that your credit card or Stripe account has been charged. Your card/Stripe account is debited at the same time you submit your order on our Website. If your order has not been approved, you will be notified immediately via our Website or by Stripe.
In the rare instance that your order is approved but any of the items you have ordered are not available, we will contact you immediately by e-mail to arrange for a full refund.
Unless you cancel your order, acceptance of your order and completion of the contract between you and Thoreau will be completed when we e-mail you to confirm the goods have been dispatched. The Website and communication is always conducted in English; therefore, the final sale contract will also be in English.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria.
The risk of loss and title for product(s) purchased by you pass to you upon our delivery of the product(s) to the carrier.
Purchasing products on the Website is only available to individuals who meet our terms of eligibility.
All purchasers must be over 18 years of age. All purchasers must have been issued with either a valid credit card by a bank acceptable to Stripe or a valid Stripe account. All purchasers must agree to authorise Stripe (on behalf of Thoreau) to process the charge or charges on his/her credit card or Stripe account in the amount of the total purchase price for the merchandise which they purchase.
By making an offer to purchase an item(s), you expressly authorise Stripe (on behalf of Thoreau) to perform credit checks to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
Furthermore, you agree that Stripe (on behalf of Thoreau) may use personal information provided by you in order to conduct appropriate anti-fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
Thoreau monitors returns to identify potential misuse or abuse of our return policies. We flag customers who meet our criteria for excessive returns. Customers who are flagged may be subject to our review, and revocation of standard customer return policies. We reserve the right to refuse service to anyone.
Termination of Access and/or Services
Thoreau reserves the right to terminate access to this Website at any time and without notice. Thoreau also may terminate the services or any portion thereof, or any products or services offered through this Website.
There are no cash alternatives to Promotion codes, which are non-transferable. Any refunds provided in relation to goods purchased using promotional codes will be equivalent to the discounted purchase price and not the normal retail price. Promotional codes cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided. Only one promotional code per customer can be used.
Cancellation by Thoreau
We will do everything we can to ensure your order is fulfilled. However, if there is insufficient stock to fulfill your order we reserve the right to cancel the order. In the event of cancellation, we will notify you by email within 48 hours of receiving your order and will re-credit your account immediately. Thoreau will re-credit your account for the value of the goods and shipping but does not reimburse any bank charges you may have incurred in the transaction. Your refund will be credited to the same card used to make the original purchase.
Please allow between 5-10 business days for your bank to complete the refund transfer, depending on their processing time. This can vary greatly between card issuers, and unfortunately, we are unable to influence this.
Cancellation by You
Thoreau aims to ship orders the same day we receive them (excluding weekends and public holidays). However, please allow between 2-3 days for processing time. If you contact us and the order has already shipped, we cannot cancel the order. However, if the order has not been shipped, we will happily cancel the order and refund you.
Insurance and Delivery
Thoreau insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by Thoreau and transfer of responsibility in the same way.
Thoreau cannot be held responsible for courier delays and circumstances out of our control. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. Thoreau is not responsible for any delays caused by destination customs clearance processes.
